Megan’s Law is the common name given for laws that require authorities to make public knowledge of the name and residence of convicted sex offenders who have harmed children. However, because the positive effects of this public knowledge are questionable, the laws are often challenged by those who feel their convictions have mitigating circumstances that should relax the ferocious grip the current law assesses them.
In addition to pedophile labeling, the families of registered sex offenders oftentimes unfairly feel the weight of the charge as well. Additionally, Megan’s Law has not produced conclusive evidence of its effectiveness in shielding society from repeat child sex abusers. Many of those on its rolls could be there unfairly, if not unconstitutionally.

Why Is This Retiering Important?
In general, in states applying risk-based sex registry schemes, low-risk (tier one) offenders are often excluded from public disclosure. In some states, only the highest-risk (tier three) offenders are subject to public disclosure, while some states, including New Jersey, also include moderate-risk (tier two) offenders on public websites. Determining the tier level, and whether or not a person would be subject to public disclosure when relocating to another state, might be close to impossible to tell without consulting an attorney and/or officials responsible for managing registration in the destination state, due to constantly changing laws and vagueness in some states legislative language.
