2 Dead, 4 Injured in New Jersey Accident

The Law Office of Joel M. Bacher Feb. 1, 2020

Two people were tragically killed and another four were sent to local hospitals following a serious crash on the Garden State Parkway, according to local authorities. New Jersey police on the scene confirmed the deaths of two people — an out-of-state woman and another individual — in the auto accident that involved five vehicles. No charges have been filed at this time.

According to the information provided by the police report, it appears a southbound SUV driven by a 57-year-old woman went out of control on the GSP, striking a concrete barrier before flipping over into the northbound lanes. This caused the vehicle to strike four other vehicles, including another SUV, all headed northbound. The driver of the southbound vehicle was pronounced dead at the scene.

Also dead was a 29-year-old passenger in one of the struck vehicles. The driver of that vehicle was rushed to a hospital with injuries described as serious, while the driver and two passengers in another vehicle suffered moderate injuries. Thankfully no one else was hurt in the crash. State police closed the GSP for several hours to facilitate their investigation into the cause of the crash, which is still unknown at this time.

If the deceased driver is found to be at fault for the auto accident, no charges will be filed. However, separate from any criminal charges, New Jersey law allows the surviving family of the deceased passenger, as well as the injured parties in the other vehicles, to file wrongful death and/or personal injury lawsuits against the deceased driver’s estate in civil court. Evidence of that driver’s negligence regarding the accident will be required if damages are to be awarded.
